Terms & Conditions
It is understood that there are no agreements and/or representations made, other than those provided in the contract. The undersigned warranties that he or she has title or ownership to the property where the window and doors are installed.
In the event of the customer’s default at any time and/or the account is turned over to an attorney for collection, the undersigned agrees to pay reasonable attorney’s fees and collection costs in addition to the balance owed. Customer hereby waives a trial by jury in the event that any litigation commences.
The first time a check is returned by the bank for insufficient funds, a charge of $40.00 will be added to the customer’s account. In the event the check is returned a second time for insufficient funds, a charge of $60.00 will be added to the account, in addition to the costs incurred above.
Repossession and resale, (a) The title to the property installed under this contract shall be, and remain, with Affordable Windows unto the purchase price, or any judgment therefore, shall be fully paid, and, in the event of a default in the payment of any one of the installments herein provided for, Affordable Windows shall have the right to enter upon the premises of the customer, or any other place where the property shall be located and remove the property, or any part thereof.
The foregoing contains the whole of the contract between the parties hereto, and this contract may not be varied by any oral representation or promises.
All material is guaranteed to be as specified. All work is to be completed in a workman-like manner according to standard practices. Any alteration or deviation from the above specifications involving extra costs will be executed only upon written orders and will become an extra charge over and above the estimate. All agreements are contingent upon strikes, or delays beyond our control.
Conditions of Sale
You are required to pay the amount due in full on the installation date by bank check or money order. There will be a $75 reschedule fee. NOTE: there will be a 3% credit card fee on all transactions. The late payment fee is calculated using a rebate of 1.5% per month, calculated on a daily basis on the outstanding balance from the install date. Annual rate of 18%. Affordable Windows is the owner of record until payments are made in full. Affordable Windows further reserves the right to repossess all material insoles on the customer’s premises. The customer consents to Affordable Windows employees and/or agents entering the premises to repossess materials.
